Vybz Kartel New Evidence May Cause Mistrial, Cellphone Tampered With
One of the critical text messages prosecutors used to convict entertainers Vybz Kartel and Shawn Storm was apparently created six weeks before the victim’s alleged death based on metadata, one attorney told the Appeal Court.
One of the attorneys representing Shawn Storm ‘Bianca Samuels’ referred to the text message found on one of the mobile phones taken from Kartel, which said that Clive ‘Lizard’ Williams “chop up fine, fine.”
This submission was made by Bianca Samuels in the appeal against the conviction and prison sentence filed by the two entertainers.
Samuels stated that the evidence presented during the 17-week trial that ended in April 2014 showed that the metadata was created on July 6, 2011, which was six weeks before prosecutors claim Williams was killed.
Samuels also noted, that there was evidence that the mobile phones taken from the entertainer were used while they were in the custody of the police.
Samuels said “this left me puzzled, along with Isat Buchanan and Daynia Allen who represent Shawn Storm.
The judges hearing the appeal appeared surprised by the assertion of new evidence.
“Our silence was sharing in your puzzlement,” said the president of the Court of Appeal Justice Dennis Morrison, who along with justices Patrick Brooks and Frank Williams, is hearing the case.
“This raises more than a reasonable doubt,” said Samuels regarding the integrity of the evidence, which initially should not have been put to the jury.
